This category is for members of the profession holding:
-
Advanced degrees (Masters or above) or
-
Equivalent (Bachelors + Five years of progressive experience) or
-
Who, because of their exceptional ability in the sciences, arts or business will substantially benefit prospectively the Nation.
The Individual worker will be required to have an employer offering permanent sponsorship. The individual worker will be required to show the lack of U.S worker availability via the Labor Certification process. The Labor Certification process is the prerequisite to filing with the USDHS for an Immigrant benefit. The Labor Certification process is an expedited PERM process.
Once perm is approved, the individual worker can proceed with the Immigration Dept. for Immigrant visa or adjustment (green Card). Note that the immigrant visa or adjustment will only be available when the worker’s Visa Number is current and available.
This (EB-2) category is generally open with sufficient visas numbers available and hence is its major advantage to the (EB-3) classification. There is always a possibility of a backlog or retrogression of visa numbers especially for foreign nationals of China and India. The retrogression of EB-2 visa numbers will be significantly less than other categories. |
